新时代大学生肩负实现中国式现代化的宏伟历史使命,其中中国式法治现代化是中国式现代化的题中之义。新时代大学生的法治素养很大程度上决定着中国式法治现代化的建设进程和实现程度。因而对新时代大学生法治素养的研究具有至关重要的价值意义、理论意义和实践意义。本文主要从价值意义维度,探讨新时代大学生的法治素养具有“拓领域、强法治、育新人”的价值意蕴;从理论意义维度,探讨新时代大学生法治素养的构成要素,形成大学生法治素养构成要素的理论模型。大学生法治素养的构成要素包括法治知识、法治思维、法治能力和法治信仰。法治知识是大学生法治素养的知识要素,法治思维是大学生法治素养的逻辑要素,法治能力是大学生法治素养的实践要素,法治信仰是大学生法治素养的精神要素。从实践意义维度,探索新时代大学生法治素养的生成机制以促进大学生法治素养的全面生成。大学生法治素养的生成机制包括以系统法治教育、大学生自我法治教育和社会普法教育为内容的教育生成机制,由以现实利益为动力的利益保障生成机制、以全面依法治国为目标的制度保障生成机制和以法治权威为素养的信仰保障生成机制构成的大学生法治素养保障生成机制。
Abstract:College students in the new era shoulder the grand historical mission of realizing Chinese-style modernization, in which Chinese-style modernization of the rule of law is the meaning of Chinese-style modernization. The legal literacy of college students in the new era largely determines the process and realization of Chinese-style rule of law modernization. Therefore, it has crucial value, theoretical and practical significance for the research of college students' legal literacy. This paper mainly discusses the value implication of college students' legal literacy in the new era from the dimension of value significance: “expanding the field, strengthening the rule of law, and educating new talents”. From the dimension of theoretical significance, this paper discusses the constituent elements of college students' literacy in the new era, and forms a theoretical model of the constituent elements of college students' legal literacy. The constituent elements of college students' legal literacy include: rule of law knowledge is the knowledge element of college students' legal literacy, rule of law thinking is the logical element of college students' legal literacy, rule of law ability is the practical element of college students' legal literacy, and rule of law belief is the spiritual element of college students' legal literacy. From the perspective of practical significance, this paper explores the generating mechanism of college students' legal literacy in the new era, and promotes the comprehensive generation of college students' legal literacy. The generating mechanism of college students' legal literacy includes an education generating mechanism with systematic rule of law education, college students' self-rule of law education and social legal popularization education as the content, a mechanism for generating college students' legal literacy composed of interest guarantees driven by practical interests, institutional guarantees with the goal of comprehensively governing the country according to law, and faith guarantees with the authority of the rule of law as literacy.
